Belfast Trust Heart Procedure Concerns: Your Rights and What to Do Next

Nonetheless, for patients who underwent an invasive procedure they may not have needed, the news is understandably distressing.

What Might This Mean for Affected Patients?

For some patients, a review may provide reassurance that their treatment was appropriate. For others, it may confirm that they underwent a procedure that was unnecessary, or that their care fell below the standard they were entitled to expect. An unnecessary invasive cardiac procedure can carry real consequences, including physical harm, complications, and significant psychological distress.

Where a patient has suffered harm as a result of treatment that was not clinically justified, they may be entitled to bring a clinical negligence claim. Every case turns on its own facts, and being part of the recall does not, by itself, establish that a claim will succeed. It does, however, mean that it is sensible to understand your legal position.

The Legal Position: Can You Bring a Claim?

In Northern Ireland, a clinical negligence claim rests on a two-fold test.

First, there must be a breach of the duty of care. Medical practitioners automatically owe a duty of care to their patients, so this element is readily satisfied. The key question is whether that duty was breached — in other words, whether the care provided fell below the standard reasonably expected of a competent practitioner. Carrying out a procedure that was not clinically necessary may amount to such a breach.

Second, there must be a causal link between the breach and the harm suffered. It must be shown that the injury or harm was caused by the substandard care, rather than by some unrelated factor. Where both breach of duty and causation can be established, a clinical negligence claim is likely to succeed.

Because these cases can be medically and legally complex, expert medical evidence is almost always required to assess whether treatment was necessary and whether it caused harm. This is why specialist legal advice is so important.

What Should Recalled or Affected Patients Do Next?
